General Rules

We have zero tolerance for any kind of harassment, bullying, scamming and violations of the laws of Australia. If you break the rules, your access will be suspended.

We recommend that you learn about ListinGifts’s posting policy before you list an item. All ads with prohibited items will be immediately removed from the site.

Do not sell any prohibited items. Check out the list of prohibited goods in your country or in the host country. Do not put yourself in a deliberately difficult position. The laws of each country penalize the sale of prohibited goods. Please think and be mindful of what you are putting up for sale. Any prohibited items will be removed from our marketplace.

  1. Let’s respect each other!
  2. The website is located on the territory of Australia and is subject to the laws of Australia.
  3. It is prohibited to post ads and information contrary to Australian law.
  4. The posted announcement must have a clear and understandable description that does not allow two or more interpretations.
  5. It is forbidden to post information that violates the generally accepted moral standards, containing viruses or data that may damage the computer.
  6. You are solely responsible for all information that you submit to ListinGifts and any consequences that may result from your posting.
  7. We do not accept postings which require candidates to send money.
  8. Any posts that contain links to other websites will delete.
  9. Your unpublished ad will stay on your profile for 2 weeks and then be deleted.
  10. We will remove ads that breach our posting rules and/or our Terms and Conditions.
  11. The Administration of ListinGifts is not responsible for the posted data, private opinions and advice expressed in the posts, as well as for contracts, transactions and other relationships that may arise between the Users. In this case, ListinGifts does not check the credentials provided by the User in any way, is not liable to any third parties for the accuracy and reliability of the credentials and does not regard the credentials provided by the User as personal data of the User.
  12. Do not use profanity, slang, and other words and expressions in the ad text that may offend other people.
  13. Counterfeit/replica products, pirated or copied media, modified game consoles, or any items that facilitate copyright infringement in any manner are not permitted on ListinGifts.

Prohibited

  1. Post information that is contrary to the Australian law
  2. Post banned products or goods that do not meet the mandatory product safety standards
  3. Post multiple identical ads
  4. Illegal items and stolen property
  5. Alcoholic beverages
  6. Tobacco products including e-cigarettes
  7. Prescription drugs and devices
  8. Illegal drugs and drug supplies
  9. Hazardous Materials
  10. Counterfeit products
  11. Pornographic material
  12. Fireworks
  13. Any animals
  14. Any products not listed here but prohibited

Indemnity

Seller agrees to defend, protect, hold harmless and indemnify ListinGifts from any claims, suits, liabilities, damages, losses or expenses, including:

  1. Reasonable attorney’s and consultants’ fees and expenses,
  2. Expenses of recall, inspection, testing, and replacement or correction of goods or services of every kind and nature, and
  3. Consequential damages asserted against or incurred by ListinGifts that arise from:
    • actual or alleged infringement of patent, copyright, trademark or intellectual property rights;
    • violation of any federal or state unfair trade practice or consumer protection laws;
    • the purchase, sale or use of products supplied by Seller to ListinGifts; or
    • seller’s breach of representations or warranties.
